Contract vs. Consent - Don't get these mixed up!
criminal cuet_pg beginner myth_bustMaine socha tha I understand Contract, and then the paper happened ๐. Now, I'm here to tell you that most coaching notes and institutes get one thing wrong - they equate contract with consent. Nahi, yeh sahi nahi hai! Consent is a necessary condition for a valid contract, but it's not the same thing.
Take the example of the Indian Contract Act, 1872 - Section 14. It clearly says that there must be free consent, but what exactly does that mean? It means the parties involved must give their consent without any duress, coercion, or misrepresentation. Consent can still be invalid if it's obtained through these means. Just remember, if the consent is vitiated, the contract is invalid. Simple, right? Not according to my coaching notes, that's for sure!
