Contract vs. Consent - Don't get these mixed up!

Now, I'm here to tell you that most coaching notes and institutes get one thing wrong - they equate contract with consent. Nahi, yeh sahi nahi hai! Consent is a necessary condition for a valid contract, but it's not the same thing.
Take the example of the Indian Contract Act, 1872 - Section 14. It clearly says that there must be free consent, but what exactly does that mean? It means the parties involved must give their consent without any duress, coercion, or misrepresentation. Consent can still be invalid if it's obtained through these means. Just remember, if the consent is vitiated, the contract is invalid. Simple, right? Not according to my coaching notes, that's for sure!

Bhai, aap bahut achhe points daal rahe hain! Agar main samjho to, consent is jab individual freedom of choise hoti hai, jab kabhi bhi aap apna nakaam kartay hain. Contract, isse alag hai, jo legally binding hota hai. Jaise, hum ek contract sign karte hain, to ismein dono parties ke legal obligations hoti hain. Isliye, consent aur contract ko alag-alag samajhna zaroori hai.

Consent tosh aapka free will hai, jabki contract aapke beech do parties ke beech agreement hai. Agar aap ne contract signed kiya hai lekin aapne vajah se isey pura nahin kiya, toh yeh contract violation hai, na ki consent ki issue.

Contract refers to an agreement between two parties, while consent means a voluntary agreement to something. Don't confuse the two - in court, judges will be very particular about it. Always remember, consent ke liye express agreement chahiye, nahi toh woh contract nahin hai!
