Contract Law Reform Needed: Voidable Contracts Section 19
contract ap_lawcet advanced reform_ideaKya yeh section 19 ko 2025 mein koi zaroorat hai? I recently studied this and I'm like what? So, if a person is of unsound mind or under duress or misrepresents their capacity, the contract can be voidable. But what about cases where the person knows they're insane but wants to make a contract anyway? Current law says still no problem. And what about online contracts? If someone creates a fake online persona or pretends to be a professional, is that not misrepresentation? Section 19 needs a serious update to tackle these issues.
Example: In 2017, a court voided a contract between a mentally ill patient and a lender. But what if the patient had a will to sign, or online contracts where the person is fully aware of their actions? It's time to rethink this section. What are your thoughts, guys?
