Contract Law: Overemphasis on Judicial Activism at the Cost of Legislative Intent
constitutional clat_pg advanced hot_takeMaine socha tha contract law ke andar judicial activism ko zyada emphasis diya jata hai, legislative intent ke bharose nahi. Lekin, ye reality hai ki sabse badi baat yeh hai ki contract law ke rules aur judgments ke baad mein ismein judai hone ki koi guarantee nahi hai. Ab contract law ke andar jo bhi hoga, woh hamesha judicial interpretation ke bharose hai.
Isliye, main khaana chahta hoon ki CLAT PG/AILET PG meiin contract law ke andar legislative intent ko zyada focus diya jaye.

I strongly disagree with the notion that judicial activism is at the cost of legislative intent. A good judge must interpret laws keeping the welfare of citizens in mind, not just stick to the literal meaning. If the legislature is not doing its job, it's the judiciary's duty to fill the gap. Judicial activism is actually a check on legislative power & ensures justice is served, woh kya karega? Judges mustn't be bound by outdated laws; they must adapt to changing times.
"Bhai, ye article bahut achi laga! Judicial activism ki overemphasis contract law mein legislative intent par asar dalti hai. Main samajhta hoon ki Supreme Court judges ko apne faislayon mein sabse zyada dhyan contract parties ke rights mein lagna chahiye. Lekin, koi bhi faisla legislative intent se bhaut jyada hi alag hojata hai. Hamein legislative reform aur judicial accountability par dhyan dena chahiye.
