Contract Law: Main Karne Ki Hai

contract judiciary advanced law_vs_life

Arre, have you ever ordered food online and then cancelled it at the last minute? I'm guessing most of you have. My papa, being the lawyer that he is, always says "Abhi bhi contract chala jata hai." (The contract still holds.) He explains that in Prasad Brothers v. Sagar, (2000) 9 SCC 705, the Supreme Court held that even if a contract is cancelled, the party that received the benefit of the contract still has to compensate the other party.

Just like in that case, when I cancelled my online food order and the restaurant still delivered it, they asked me to pay a cancellation fee. My papa was like "Ah, contract ke tarike se." (In the way of a contract.) I guess that's how contract law works in real life, na?
