Maine socha hai, sir, aapka point wrong hai! Agar ek contract mein express term nahi hai, toh bas implied term hi nahi hoti. Implied term to sirf express term ka extension hai, jiska matlab yeh hai ki jhootha nahi hua hai. Maine apne notes me padha hai, to aapke point se mujhe lagta hai yeh sahi nahin hai.
Arre, bhai! Express terms aur implied terms don't seem like much, but unka difference bahut bada hai. Express terms direct rahi, jaise ki 'You will deliver the goods on time.' Implied terms lagbhag samjhe jaate hain, jaise ki 'You will deliver the goods in good condition.' If implied terms breached ho jatai hai, unhe nahi direct evidence chahiye, rather reasonable expectation hota hai.
