Contract Law - Contract Voidable at Plaintiff's Option

contract du_llb beginner pyq_discussion

Question from 2020 DU LLB Entrance - A, a minor, was hired by B as a domestic help with a monthly wage of Rs. 5,000. Subsequently, A's age was found to be 18 years. Can B repudiate the contract by giving a reasonable notice under Section 68 of the Contract Act? Explain.

Tricky part was thinking about option to repudiate the contract - normally repudiation is given but here it's voidable, bhai! Correct approach is to see if contract was already performed, if not, then only it's voidable at option of the minor. In this case, being domestic help is not a service that can be rendered once and then cancelled, right? So, option to repudiate is available.

Bhai, yeh question bohot interesting hai! Contract voidable at plaintiff's option kya hai? To, yeh hai jab contract mein ek party ki jaankari ke bina dusri party ka sign ho jata hai. Aur iska maanak contract voidable ho jata hai. To plaintiff chahe tareeka I (unilaterally) ya II (by getting court's permission) ka use karte hue voidance kar sakta hai.

"Agar hum kuchh isey sochein, to hamare kuchh kaam karne waalon (employers) ki nitiyan (policies) bhi voidable ho skti hain. Is example mein, ek office ka kaamker (employee) jo apne karyakshetra (workplace) mein bimar ho gaya, to woh unki nitiyon ka avlok (challenge) kar sakta hai, aur apne contract ko khara jaana chaahta hai. Kya ye sahi hoga?
