Constitutionality of the Right to Education Act:

constitutional ts_lawcet beginner pyq_discussion

Yaara, sabne TS LAWCET ka pehla exam diya hai, kya? One question that lagi thi last year: "Examine the constitutional provisions for providing free and compulsory education to children aged 6-14 years. Analyze the provisions of the Right of Children to Free and Compulsory Education Act, 2009. Discuss whether the Act is violative of the fundamental right under Article 21A."

Kya hai approach, yaar? Sabse pehle, Article 21A ko understand karna hai, main fundamental right hai education ke liye. Iske andar, SC ki decision of Unnikrishnan ka reference lena hoga. Iske baad, Right of Children to Free and Compulsory Education Act, 2009 ka analysis karna hoga, iske main provisions, jaise Section 3(1), Section 16.

Bhai, I think Right to Education Act (RTE) has been a game-changer in ensuring kuchh bhi shuru ho sakta hai (education for all). But, constitutionality ke point par, RTE Act clashes with Article 21A, which makes elementary education a fundamental right. Article 26 (a) also comes into picture, sabse badi problem hai, the Act doesn't specify which religious institutions will be exempted.
