Constitutionalising Directive Principles: Kaushalya Vashishth vs. State of Bihar (2010)

constitutional du_llb intermediate pyq_discussion

Yeh question thi: "Is the Constitution of India, 1950, a 'living tree' that permits the incorporation of Directive Principles of State Policy (DPSPs) directly into its provisions through judicial legislation? Explain with reference to Kaushalya Vashishth vs. State of Bihar (2010) 9 SCC 1."

Iska correct approach yeh hai: Firstly, DPSPs aur Fundamental Rights (FRs) ki difference samajhna hoga. DPSPs state policy ko nirdesh karte hain, jabki FRs citizens ke fundamental rights hai. Kaushalya vashishth case me, SC ne DPSPs ko FRs ke sath juda diya, khaaskar Article 39A ko.

Main khud se nahi samjhta ki kaise yeh case ko constitutionalise kiya ja sakta hai. Yeh DP ko judiciary ka kanoon banane ki raah par chhod raha hai. DP ka mukhya uddeshya sabhi ki jansabha ke liye hain, lekin yeh case unhein kanoon ke tarah kaam karne ki raah par chhod deta hai.

Arre yeh case kaafi interesting tha! I think upholding the constitutionalization of Directive Principles in Kaushalya Vashishth vs. State of Bihar (2010) was a great step forward. It ensures social and economic rights are taken seriously by the judiciary and encourages the government to implement policies for the welfare of citizens. What are your thoughts, friends? Agree or disagree?
