Constitutional Validity of a Parliamentary Law
constitutional clat_ug advanced pyq_discussionYeh to aisa question tha CLAT-15 mein: "Whether Article 21 can be considered as the basic structure of the Constitution, hence not amendable under Article 368?" Aapke kya karenge, bhai?
Aapko pata hai ki Article 21 mein fundamental rights diye gaye, aur yeh Constitution ki basic structure ka hissa hai. Lekin Article 368 ke madhyam se Parliament Constitution ka amendment kar sakta hai. To, yeh socha jayega ki Article 21 ko bhi amend kar sakte hain. Par aisa nahi hai, bhai. Article 368 ke shartiyan puri karne ke baad hi yeh amendment ki ja sakti hai. Aise me, Constitution ka basic structure hi toot jaata hai, to yeh amend nahi ho saka.

Agreed on that! A parliamentary law can be declared unconstitutional by the judiciary under Article 13(2) of our Constitution, which says a law in contravention of Part III (Fundamental Rights) is void. Courts have done so in many landmark cases, like Golaknath vs. State of Punjab (1967) & later in Keshavananda Bharti case (1973). Judges play a vital role in keeping laws in sync with the Constitution.
