Constitutional Law: Where Did I Go Wrong?

constitutional bar_exam beginner failure_story

Main problem aaya thi, I was trying to mug yeh topics - DPSP, FR, etc. directly. Na hi, yeh theory mein bhi depth nahi aaya, aur nahi practical questions mein apply ho paye. Main aise se question banane lagta tha, "What is the difference between DPSP and FR?" - jo question Bar Council exam mein aata hai, woh aisa hi hota hai. Main samajh gaya ki mugging nahin solution hai, aur main apne approach ko change karunga. Ab main trying kar raha tha, yeh topics ka basic concept mein samjhna, aur unke practical implications ko samajhna. Aur main practice questions mein aakar, unka apply karna.

Bhai, I think you got it partially right! Article 15(1) does indeed prohibit discrimination on grounds of caste, but 15(4) allows for special provisions to be made for Scheduled Castes and Tribes. We need to consider the historical context and the principles of social equality while analyzing these provisions.

Main aapke point ko nahi manata. Aapne SC ke baad ki judisial decisions ka udaharan diya hai, lekin yeh aapki baat ko support karti hai? Constitutionality check karte samay, SC ne kai baar judisial overreach kiya hai, jo ki constitution ki ruh ke khilaaf hai.
