Constitutional Law - Harsh Truths Behind Article 21
constitutional clat_pg intermediate internship_learnI was interning at a High Court when I read a judgment that made me go, 'Arre, kitna kathin hai!' They were interpreting Article 21 which guarantees the right to life and liberty. What surprised me was the court's emphasis on the 'quality of life' rather than just its 'length'. In the case of Olga Tellis vs Bombay Municipal Corporation (1986), the court held that even the 'right to livelihood' can be considered under Article 21 if it affects the quality of life of a person. It was a wake-up call for me as a student to think beyond our textbooks and consider the practical implications of constitutional provisions. Now, jab hum CLAT PG / AILET PG mein jaane waale hain, humein is bat ko dhyan mein rakhna hoga.
