Constitutional Law: Apartheid in India - A Trick to Grasp
constitutional general advanced pyq_discussionYaar, last year I found this question from paper 1 of 5th semester quite puzzling. It said: "Can India replicate the Apartheid system as practiced in South Africa before 1994?"
To be honest, I'd studied the Indian Constitution and the concept of equality, but somehow I mixed up the basics. Later, after much brain-rotting, I realized my mistake. It's about the Constitution's Preamble, the Fundamental Rights (Part III), and the Directive Principles of State Policy (Part IV). We must distinguish between the Constitution's ideals and the actual implementation. If India allows Apartheid, it would be a contradiction to the basic values enshrined in the Preamble - liberty, equality, and justice. Also, it would violate Article 14 (equality before law) and Article 15 (non-discrimination).
