Constitutional Conundrum: Art 21 & Right to Food
constitutional judiciary advanced poll_styleMain hoon akele, but tum sab mere saath ho. Abhi tak 3 saalon se hoon main yeh padh raha hoon, lekin ab bhi confuse hoon kya karna hoga. Kya main correct karta hoon ya galat?
Yeh sawaal aaya hai - Kya Constitution of India mein "Right to Food" shaamil hai ya nahin? Ek vichar hai ki iske liye hume Article 21 ka istemaal karna hoga, jo ki "protection of life and personal liberty" ka pradarshan karta hai. Anya vichar hai ki koi specific article ya amendment ni hai jo iske baare mein batata hai, to isse koi bhi right nahin milta.
Tum logon ka vichar kya hai?

I think there's some confusion here. Article 21 doesn't directly guarantee right to food. In PUCL v. Union of India (2001), SC held that right to life under Art 21 includes right to food, water, shelter & healthcare, but only as incidentals towards right to life. It's not standalone right. So, we need to read it in conjunction with Directive Principles of State Policy (DPSPs) like Art 47 which talks about public health & nutrition.
Main aapke haazir ho raha hoon, lekin maine socha hai ki aapke vichar galat hai. Article 21 ka arth hai "any law which denies life or personal liberty is void". Ab, Right to Food ki bhi ek aisi cheez hai jismein humare adhikaron ko mazbooti se rakha jaata hai.
Bhai, yeh topic bahut interesting hai! Article 21 ke liye, right to life includes right to food, but don't forget that it's a qualified right. SC ke pass flexibility hai to balance individual right with woh situation jahan food scarcity ya scarcity of resources hai. Toh, yeh Article 21 ke scope tak hi sahi hoga jab government kareebi mein khane ki guarantee denge.
