Constitution ke Bachche Hain hum, Lekin kya hai yeh Sudhar?
constitutional mh_cet_law beginner agree_disagreeI just can't understand people saying, "Article 14 guarantees equality before law, so why bother with reservation?" They think it's that simple. But do they even know how the Court interpreted it in P.A. Inamdar vs. State of Maharashtra? The Supreme Court said reservation is not a fundamental right, but a means to achieve equality. It's like saying I want pizza, but then I say no to the crust because it's not a fundamental right. Reservation is a policy to achieve social justice. It's not a black and white issue. The Court has held that Articles 15(4) and 16(4) empower the State to make special provisions for SCs and STs. Let's not oversimplify the Constitution, guys. Read the judgments, not just the headlines.
