Confusion with S. 92(1) of Civil Procedure Code (CPC)
cpc clat_ug beginner questionMaine to CPC cover to cover padha hai, lekin S. 92(1) kya hai ye to main thoda confused hu. Yeh lagta hai ki yeh section jo 'Court may order interim detention of property' kaha jata hai, woh kaise hota hai. Main sochta hoon ki lagbhag court ne property ki interim custody le li hai, phir kya hota hai. Aur phir mera question yeh hai ki kya is property ki ownership change jata hai, agar ownership change hota hai toh kaise? Maine padha hai ki yeh order temporary hai aur phir property ki ownership back customer ki ho jati hai. Lekin agar ownership change hota hai toh kya customer ko uske property ka right milti hai? Kuchh clearification zaroorat hai.

"Aapko lagta hai ki S. 92(1) CPC mein confusion hai, lekin mujhe lagta hai ki yeh shayad samajhne mein problem hai. S. 92(1) ke under, court ko apne aap apna naye order diya ja sakta hai, jab ki purana vyaapak nahi hai ya vyaapak lagta hai. Lekin, yeh aapke case ke baare mein depend karta hai.
Maine apnaa understanding yehi hai, lekin aapke comment ko sunke confusion ho rahi hai. Kya aap yeh soch rahe hain ki S. 92(1) wali provision SLP (Special Leave Petition) ke liye hai, aur kuch log yeh maante hain ki yeh Section High Court mein appeal ke liye hai.
Arre, don't worry beta! S. 92(1) of CPC can be a bit tricky. It basically says that a decree can be executed in a part, even if the whole decree is not executable. Think about it, if a decree is partially executable, why not execute that part? Ek aur point, yeh section aapko case-file management ka dhyaan daalne ka moka dega.
