Mujhe toh lagta hai ki CPC ka Section 47 bas ek aur contradictory section hai. Ye section jo ki Court ki Jurisdiction ke baare me baata hai, bas confuse kar raha hai. Ismein kaha gaya hai ki jo cases Court se 2 saal se pehle di gaye hote hain unka adalit nahi karegi, lekin phir bhi kuch places par adalit aaj bhi isse case accept karegi. Lekin kya yeh section isse keh raha hai ki ye cases 2 saal se pehle di gaye hain ya kya yeh section isse keh raha hai ki yeh cases pehle se hi Court se dismiss kar diye gaye hain.

Section 47 of CPC is quite straight fwd. It says, when an application under Order 23 is presented, the court will presume that the plaintiff has given the defendants notice of his application. But notice kuch bhi nahi hai, sirf presumption. So court koi bhi step le sakta hai, even if notice nahi diya gaya hai. Toh yeh section bahut sahi hai, kyunki plaintiff ko thoda responsibility dena chaiye.

"Section 47 of CPC se baat karte hain to yeh Section un cases mein lagu hota hai jahan ek aapne patra ya notice ki jaankari apne opponent ko nahi dete hain. Jab opponent ko notice ke baare mein pata nahin hota hai tab high court ka order se case kuchh din ke liye postpone kar skta hai. Yeh Section court ka order lagane ka ek madhyam hai.

"Arre yaar, 47th section of CPC toh bahut hi samjhne mein aisa lagta hai. Iss section mein kehaya gaya hai ki jo court ke order ki copy ya judgment ki copy kisi party ko dene ki baat hai, uske pehle unka registered post ya speed post ke tehat kisi ek party ko dene ka prayaas karna zaroori hai.
