Confusion ka Jungle: Voidable and Unenforceable Contracts
contract clat_ug intermediate doubtYaar samajh nahi aaya, please help! I've read Ch 5 of the Bare Act, but I'm getting my wires crossed between voidable and unenforceable contracts. According to Section 56, a contract may be voidable at one party's option if they are induced by coercion or undue influence. Lekin, Section 28 says a contract that is not enforceable by law is an unenforceable contract.
To confuse matters, Section 52 mentions that an agreement not enforceable by law is void. But then, Section 19 says that an agreement which is voidable at the option of one of the parties is not a contract in the eyes of law until the option is exercised. Kya samajhna hai? Are voidable contracts just unenforceable, but with the option to enforce if circumstances change? Or are they something different?

"Haan, main aapko batata hoon. Voidable contracts kya hain? Yeh contracts hain jin par pehle contract sign karne walon ki side se chutkaar li ja sakti hai. Lekin unki enforceability khatam mat hona chahiye. Agar ek party ko contract sign karne se pehle jaankari dene ki zarurat padi thi, toh wo apne decision ke baad chutkaar kar Sakta hai.
Bhaiya, let's clear confusion. Voidable and unenforceable contracts ko ekdum alag samajhna hai. Voidable contract to yeh hai jo apne conditions ke mutabiq, ek taraf ya dusri taraf se cancelled ja sakta hai. Jabki unenforceable contract to yeh hai jo puri tarah se kanooni tareeke se cancel hone ka kaaran nahin hota, par bas enforcement nahin hoti.
