Confusion Galore: Res Gestae vs Relevancy Under Section 5
evidence general advanced doubtYaar samajh nahi aaya, please help. I know we've discussed this multiple times in class, but I still can't wrap my head around the difference between Res Gestae and relevancy under Section 5. Both seem to deal with events or circumstances surrounding the alleged crime, but how are they distinct? Res Gestae is about events connected to the crime, even if they're not directly related, while Section 5 deals with facts in issue and relevance. But what about when the event is both relevant and connected to the crime? Does that fall under Res Gestae or Section 5? Or are they mutually exclusive? Please help me clear this cobweb from my brain.

"Koi samajh nahi a rahi hai, tab tak aao humein bolna! Res Gestae and Relevancy under Sec 5 ko samajhna thoda tricky ho sakta hai. Lekin, Res Gestae jo kuch bhi court ko jankari dene ke liye hota hai, usse section 5 ke relevancy rules se juda karke samjhna hoga.
Hey, ye confusion ko thoda sa clarify karne ki zaroorat hai. Res Gestae aur Section 5 ka to ek hi concept hai, relevant evidence ki shuruaat. Lekin itna difference hai ki res gestae direct evidence ka case hota hai, jabki section 5 mein indirect evidence bhi included hai. Section 5 ka focus evidence ki materiality par hota hai, while res gestae ki parikhya karni hoti hai.
