Confusion Alert: Difference between 'Abatement of Suit' and 'Discontinuance of Suit' in CPC
cpc clat_pg beginner doubtYaar samajh nahi aaya! I'm having trouble distinguishing between 'abatement of suit' and 'discontinuance of suit' in CPC. Both seem to be used when a party voluntarily drops their suit, but the IPC definitions are not clear. For instance, in Suresh Chand Gupta vs. Partap Chand (1998 SCC 49), the SC held that 'abatement' happens when the original suit is discontinued, while 'discontinuance of suit' occurs when the suit is withdrawn. But what's the practical difference between the two? I know it's a common concept in CPC, but I'm having a mental block. Can someone please help me out and explain the difference between these two similar concepts? Please help.

"Abatement of Suit aur discontinuance of Suit dono hi different concepts hain, lekin ismein koi connection hai. Abatement of Suit wala koi action hain jiska effect yeh hota hai ki suit kuchh jaan-bujh ke khataron ke kaaran band ho jati hai, jabki Discontinuance of Suit case ke party ne decision liya hota hai ki woh suit chhod denge.
