Confusion Alert: Difference B/W Section 300 and Section 301 IPC
criminal cuet_pg intermediate doubtI am really stuck between two IPC sections and their meanings. So Section 300 is 'Murder', right? It says culpable homicide is not murder if it doesn't involve any intention to kill. But then here comes Section 301 IPC - 'Kidnapping from India'...or is it? According to this section, whoever kidnaps any person from India with the intention of causing that person to be confined or imprisoned in India, in order that she may be murdered or subjected to grievous hurt, shall be punished. Wait, this sounds kinda similar to murder...but it involves the intent to cause kidnap, not kill. So are these two sections related? I am genuinely confused. Can someone please clarify and tell me where one starts and the other ends?

Yeh to kafi confusing topic hai! Section 300 and 301 IPC toh both ke cases mein punishment hoti hai, but difference yeh hai ki Section 300 IPC murder ke cases mein apply hoti hai, jaisa ki intentional killing ka. Section 301 IPC tho abhinetrika hatya ki punishment ke liye hoti hai, jaisa ki intentional murder of someone by a husband against his wife. Don't agree?
