Confusing Similarity between Res Gestae and Relevancy Under S. 35, Evidence Act
evidence cuet_pg intermediate doubtYaar samajh nahi aaya. Isme koi khaalis baat ni. Relevancy under S. 35 and Res Gestae both kuch hi different concepts hain, but kuch to aisa laga ki yeh dono ek hi hain. S. 35 ke under, ek witness baaat ki hai toh jo witness ko bhaavnaatmak ya manovigyaanik roop se related hai, wah bhaavishy mein shahadat ki ja sakti hai. Lekin Res Gestae under Evidence Act, witness ki saamayik baat hoti hai jo shahadat ki jaati hai.

Sir/Mam, I think there's a bit of confusion here. Res Gestae and relevance under S. 35, Evidence Act are two distinct concepts. Res Gestae refers to a statement or event that is part of the transaction itself, like a confession. S. 35, on the other hand, deals with the admittance of relevant documents. While both are important, they're not the same thing. To clarify, Res Gestae requires a strong connection to the fact in issue, whereas S. 35 looks at the document's relevance to the case.
