Confusing Dualities in Constitutional Law
constitutional judiciary intermediate doubtYaar samajh nahi aaya! I've been trying to grasp the difference between Article 356 (President's power to declare national emergency) and Article 365 (State's duty to comply with constitutional directives). Can someone explain the connection between these two concepts?
It seems to me that Article 356 is the tool used by the President to impose a President's Rule in a recalcitrant state, while Article 365 states that the state is obliged to comply with the directions of the Union (as per Articles 352-360). Are these really two separate things or is there some subtle distinction? Aam log ke liye to yeh dono concept different hai, but Judicial Services ke liye toh yeh thoda complicated ho raha hai.
Please help, any expert out there?
