Confused on Capital Gains Exemption u/s 54 v/s 54EC
tax judiciary intermediate doubtMaine kuch time pehle Judicial Services ke liye Tax Law ko padha, lekin do concept dono ek-jaisa lag rahe hain, yaar samajh nahi aaya. Maine socha kya main galat pad raha hoon ya ye to bahut hi complicated concepts hain, jo hamesha pehle padhne ki zaroorat padti hai. To, 54 v/s 54EC ka kya farak hai? Koi aisa condition hai jaha 54 ki exemption 54EC tak bhi lag jata hai ya phir 54EC ka koi vikalp 54 tak bhi mil sakta hai? Yaar please help, ye dono concepts mein thoda kaafi confusion hai. Koi iske bare mein detail se explain kar dega?

Bhai, both sections are related to long-term capital gains exemption, but with some differences. Section 54 allows exemption up to โน2 crores if investment is made in a residential house. On the other hand, section 54EC allows investment in specified bonds (e.g. rural electrification, infrastructure bonds) for exemption up to โน50 lakhs. So, chahiye aapke case mein kya hai, kisse exemption chahiye, usse decide kar sakte hain.
Bro, don't worry I got confused too till I dived into the act. So, s. 54 is for long term capital gains, where you sell a property and invest in another property within 2 yrs, no tax will be charged. On the other hand, s. 54EC is for investing in bonds, you get exemption on LTCG if you invest in notified bonds within 6 months. Easy peasy, just remember property for s. 54 and bonds for 54EC
Yaar, section 54 and 54EC ke beech main difference yeh hai ki Section 54 exemption ek property se property ki transaction ke liye hai, jabki Section 54EC mein investment in a specific 5-year bond hai, jiski rate of return tax-free hai. But, don't forget, Section 54 ke liye property should be held for at least 3 years. Make sure to check the lock-in period. It's a crucial one!
