Confused in Section F: Evidence Act - When to Admit Hearsay?

Main problem yeh hai, sir, in section F, kya hearsay ka admission toh always possible hai ya nahin? Ek sawal yeh hai, jab witness ko kuch sunkar yeh pata lagta hai ki aisa hua tha, aur usne iska jawaab diya hai. Ab yeh witness ko aana hai court, to kya yeh aisa bol sakte hain: "Maine socha tha, yeh hoga tha"? To kya yeh hearsay hai ya nahi?

Main confused hua hu kyonki kuch kshetra main hearsay ka admission acceptable hai, jab ki kuch aur main nahin. Aur yeh kis basis pe decide kiya jata hai kya? Kya yeh depend karta hai court ke vichar par?

Aapko ek baat yaad hai, kahaan kehte hain kaa section 32 mein hai, jo Evidence act ke article 32 mein bhi aaya hai. Yeh baat hai hearsay ke liye, yeh section kahaan kehte hain ke agar main ek statement ke witness kaa statement sun raha hoon aur us statement ke baare mein yeh bata raha hoon ke maine unhe yeh suna tha, to yeh admissible hai.

Bro, I think you're confusing Hearsay aur Direct Evidence. Hearsay allowed only under certain sections like S 32 (Statements of Relevant Fact by Person who is Dead or Cannot be Found), S 33 (Admissions by Person who is Dead or Cannot be Found). If it's not under these sections, it's admissible only if it falls under S 32A (Statement made by a person as to what he has observed, heard or experienced). Otherwise, it's inadmissible.
