Confused by the 'twist' in Section 300 of IPC
criminal du_llb intermediate concept_confusionBhai, I've been studying for my DU LLB entrance and I'm literally at my wit's end trying to understand Section 300 of the IPC - 'Murder.' Can someone please clarify the 'moral justification' part? It says that if a person commits murder with the intention of causing death in a 'wartime operation' or under an order from the President/Governor of a state in an 'area of operation,' it's not murder. But then, the subsequent section says that even in an 'area of operation,' if you act in 'contravention' of this order, it's still murder! Ye sab theory hai, but do you know how many people lose cases just because they don't know this section exists? I mean, what about soldiers who go rogue in an operation? Where do they stand? Someone help me understand this 'twist' in the law?

Arre, don't be confuse, yaar. Section 300 of IPC is not as tricky as it seems. Remember, murder is a cognizable offense and intent is the key. Read carefully, intent (เคธเคเคเฅเคเคพเคจ) means 'knowledge' of circumstances. If a kisan, in the heat of the moment, kills after a scuffle due to fear of loss, it's not premeditated. But if he plans it, then it's murder. Focus on 'intention to cause death' or not. This clarity will clear your confusion, inn!
Arre bhai, main bhi confused tha but ab thoda samajh gaya hai! Section 300 ke twist ka matlab yeh hai ki 'cunning or artful' murder, jaise ki kisi ko khatre mein dekar uska murder karne ka plan, IPC 300 ka pura case hai. Lekin, agar koi accident ho jaye aur woh khatre mein padta ho, phir kya? Ab to uska bhi murder IPC 300 ka pura case ho sakta hai na?
Bhai, main aapko samajh sakta hoon. Section 300 ka twist toh yeh hai ki 'intent' ki jaanch IPC 300 ke alawa bhi karni padti hai, jaise IPC 299. Jab koi murder ke intent se act karta hai, toh IPC 300 ka punishment lagta hai, lekin yeh sahi se samajhna zaroori hai.
