Confused by the Ambiguity of Section 300(6) IPC

criminal mh_cet_law advanced concept_confusion

Ye section sapne mein aata hai ab, honestly. While learning about exceptions to the rule of murder (specifically, Section 300(6) IPC), I just can't wrap my head around the doctrine of 'rioting'. Is it the intention, the act, or the consequence that matters? Section 300(6) states that if a person voluntarily causes death during a riot and the death is contributed by or results from the acts of the other persons also engaged in the same riot, then it's not murder (as it's a 'riotic death').

The ambiguity arises when one reads Section 141 IPC, which clearly says that an act done by a person participating in a riot will be considered the act of that person alone. But, isn't this supposed to apply to all participants in the riot?

Hey guys, I'm feeling the same vibes! Section 300(6) IPC is seriously ambiguous, right? One possible interpretation is that it's aimed at cases where the intention was to cause the death, but another view is that it's only applicable if the person actually intended to kill. Does anyone know if we're going to get clarity on this in the exams or is this just a tricky grey area we need to navigate?

Arre, I'm also not clear on this section. But if I recall correctly, Section 300(6) IPC talks about 'immediately causing the death' under the circumstances of an 'abandonment of a child under 7 years, or a person suffering from unsoundness of mind'. To me, it seems like there's a grey area here. Abandonment doesn't necessarily mean intentional - kya? Does a police officer's negligence constitute 'immediately causing the death'?

Arre, yeh sab confusion to Section 300(6) IPC wala hai. Sab samajhne ke liye, yeh suno: Section 300(6) IPC wala hai abhinetrihato, jahan par aapko ek se zyada ghatnaon ka samna karna padta hai, jaise ki aap ek se zyada logon ko maar sakte hain. Lekin, yeh sab depend karta hai IPC ka section aur circumstances par.
