Con Law Ka Twist

constitutional clat_ug beginner mcq_debate

Main aur mere dost ka debate ho raha hai. Question hai: Panchayats ki election kis prakaar ki hai? Panchayats (Samiteenthan) aur Panchayat Samiteenthan Adhiniyam, 1992 ki section 12 ke under, prashn kehte hain ki pratyeki panchayat ke liye election kis prakaar honge. Dost ka kaha hai ki yeh election "direct election" hai aur iske liye koi specific age limit nahi hai (Raj Narain v. Delhi Admn., 1963). Main kahunga ki yeh "indirect election" hai (State of Rajasthan v. Umed Singh, 1965) aur specific age limit lagu hai.

Ab aapke paas decision hai - kya election direct ya indirect hai aur kya age limit lagu hai?

Bhai, Con Law ka Twist to yeh hai ki constitution ke articles aur provisions ko samajhne ke liye maine kai saari cases padhi hain. Like, Article 21 ka kya matlab hai? Fundamental right of life and liberty ki guarantee karti hai. Lekin, kya abhi bhi uska matlab hai jo 1950 wale Bharat mein tha? Ismein to case laws ka role bahut bada hai.

Arey, I strongly disagree! Con Law isn't just about twisting facts, but jugaad-based reasoning. Judges use analogies and precedents to reach a verdict, not mere manipulation. Twist of facts can lead to miscarriage of justice. We should focus on logical reasoning and case law interpretation, not twisting Con Law to suit our arguments.
