Con Law Ka Bhishma Pitamah: Keshavananda Bharati
constitutional ts_lawcet beginner experience_shareI was studying for TS LAWCET and I still remember the day I struggled with Article 368. My friend Ravi, who's also preparing, asked me a question on Kesavananda Bharati - "Is the amendment of the Constitution, if it goes against the basic structure, void ab initio or can it be challenged under Article 13(2)?" I was like 'Kya hua?' (what happened?) and then I realized I had forgotten this crucial aspect of basic structure doctrine.
I scored 72 out of 100 in that section and I was disappointed. I later revised and I'm glad I did because I realized I had missed a lot. Now I can answer questions like this one - the Supreme Court held that a constitutional amendment can be void ab initio if it goes against the basic structure of the Constitution.
