Can a Doctor be Prosecuted for Abetment of Death under S. 304-A IPC?

Yaar, I think Section 304-A IPC (Causing death by negligence) ka application doctor ko abetment ka under S. 304-A IPC (abettor present when offence is committed by another) is not justified. Main reason is abetment only applies when the accused instigates or counsels the actual perpetrator, but here doctor's negligence is the root cause, not abetment. Moreover, S. 304-A clearly mentions 'causing death by doing any rash or negligent act not amounting to culpable homicide'. So, doctor can be charged under S. 304 (2) IPC (death caused by doing any rash or negligent act not amounting to culpable homicide) but not abetment.

So, what do you think, fellow students? Can a doctor be prosecuted under S.

Main aapki baat se nahi khete hain. Ye question pehle bhi kaafi baar discuss hui hai. Abetment of death ke liye S. 304-A IPC ka apnah aapko lagta hai lekin jo bhi juda hai, wo abetment of suicide hai aur ismein doctor ko prosecution ka koi case nahin ban sakta hai. Ismein doctor ki koi lagan nahin padegi.
