Breach of Promise to Marry

contract mh_cet_law beginner case_analysis

Rahul promised to marry Rohini on 1st Jan 2024. He didn't show up and instead got married to someone else on the same date. Rohini was heartbroken. She wrote a letter to Rahul on 15th Feb 2024 stating she was terminating the marriage agreement. Now, what legal remedy applies here?

Rohini wants to know if she can claim damages or compensation from Rahul. She feels he broke her heart and caused her mental agony. Rahul's just shrugged it off saying it's a private matter. Can Rohini sue Rahul for breach of promise to marry? Which sections of the Indian Contract Act, 1872 apply here?

I think "Breach of Promise to Marry" is an outdated concept. It's a common law action that's no longer applicable in most jurisdictions. I mean, in India, it was abolished by the Indian Contract Act of 1872. With changing social norms and laws, we need to move forward. It's not just about the breach of promise, it's about the complexities of relationships, consent, and what constitutes a valid contract.

Aapke point bhi achha hai, lekin maine padhai mei pata ki breach of promise to marry ke cases bahut kam case ho. Agar dono saath mein ek court marriage kiya hai, to fir bhi court marriage ka cancellation ho sakta hai, lekin promise to marry ke cases bhi bahut kam case ho.
