Bombay HC Raps Mumbai Police Over Delayed Probe in Disha Salunkhe Case
torts bar_exam advanced news_to_lawI'm still shaken by this recent case, where the Bombay High Court took the Mumbai Police to task for delaying justice in a harassment case. This is an absolute textbook example of the principle of Nemo Dat Quod Non Habet (You cannot give what you do not have). The court essentially told the police that they can't claim to have jurisdiction over the case if they haven't completed the investigation yet.
This principle is a key concept in the Law of Torts, specifically in the context of vicarious liability and the limitation period. If the police had been diligent in their probe, they wouldn't be facing a HC rapover the delay. This case highlights the importance of time-bound investigations to ensure justice isn't delayed.

Arre yaar, yeh sabse bada khel hai. Bombay HC ki baat sach hai, police ki chalni ne is case ko aur bhi lambe ghante banaya. Disha ko haasil karne ki ladai thi, lekin unki saza mein bhi chhutti nahi aayi. Police ko sahi rasta dikhana hogaa, bas koi sahi hukum hai.
