BNSS (Bailable vs Non-bailable Warrant) - The Coaches Got it Wrong!

crpc_bnss du_llb beginner myth_bust

Doston, have you ever read the BNSS sections in the CrPC? You must have, but do I blame you if you never understood it? The coaching institutes and online notes will have you believe that once a warrant is made non-bailable, the accused can't be arrested from any place. But it's a common misconception, yaar!

According to Section 70 CrPC, if the warrant is bailable, the accused can be released on bail from jail, but if the warrant is non-bailable, the accused can still be arrested from any place, but the police have to be satisfied that he is the very person against whom the warrant is issued, not just someone who matches the description! The police investigation to identify the person is what matters, not the type of warrant.
