Bharat Biotech's Covaxin Patent Row: Misrepresentation of Fact

You know what's been in the news lately? Bharat Biotech's Covaxin patent dispute! Now, this is a great example of Misrepresentation of Fact (Section 17, Indian Contract Act, 1872). Essentially, Covaxin claimed its vaccine was effective against the Beta variant of the COVID-19 virus, but when the claim was challenged, they admitted it wasn't true. That's a classic case of Misrepresentation of Fact, bhai! Covaxin made a false statement of fact to induce people to enter into a contract (in this case, a license agreement with the patent). Remember, if a party makes a false representation that induces another party to enter into a contract, it can be grounds for getting out of the contract or even claiming damages. Simple, but the implications are huge, yaar!
