Now, this is a great example of Misrepresentation of Fact (Section 17, Indian Contract Act, 1872). Essentially, Covaxin claimed its vaccine was effective against the Beta variant of the COVID-19 virus, but when the claim was challenged, they admitted it wasn't true. That's a classic case of Misrepresentation of Fact, bhai! Covaxin made a false statement of fact to induce people to enter into a contract (in this case, a license agreement with the patent). Remember, if a party makes a false representation that induces another party to enter into a contract, it can be grounds for getting out of the contract or even claiming damages. Simple, but the implications are huge, yaar!
Additional Info: Covaxin patent row hai jab bhi yeh aata hai to public ko jaanana ki Bharat Biotech ne kaha hai ki US ke patent office ke jor par unhone Covaxin ka patent wapas le liya. Lekin US ke patent office ne bataya hai ki inke rules ke under patent wapas lene ka adhar nahi tha. Isi liye Bharat Biotech ko public ke saath apne kuchh claim correct nahi kar saka.
