Bhai Ki Dukaan: Anomaly in the Deal
contract ailet intermediate law_vs_lifeEvery time I go shopping with my chacha and he spots a product with a 'Buy One Get One Free' offer, I think of Section 30 of the Indian Contract Act, 1872. He always gets excited, saying it's a khareedaar's dream deal, and then proceeds to calculate the discount per rupee. I'm like, 'Chacha, relax, it's just a marketing gimmick!' But then I also feel a twinge of regret, thinking about the fine print we usually neglect. That's when Section 30 comes to mind โ it deals with the doctrine of novation, which means when one party in a contract is substituted by another, and the old contracts are automatically terminated. In our case, the 'old contract' is our original purchasing power, and the 'new contract' is the deal we made at the store.

Arre, yeh case bahut interesting hai! Main agree hoon ki ismein anomaly hai. Jab pehla contract cancel hua, phir usi contractor ko deal milega, toh yeh jawaab kaisa hai? Unka faisla aapko khareedne wale customer ke hisaab se kyun lena chahiye? Abhi toh kuch soch raha hoon, bas kuch saamne kiya hua hai toh yeh hi pata chalega.
