Beware of the Offer, Acceptance, Consideration Trap!

contract ailet beginner trick_question

Question: Rohan and Saurav are friends since college. They agreed to start a business together and decided to draft a partnership deed. In the deed, it is mentioned that Rohan will contribute Rs 5,00,000 cash and Saurav will bring a laptop worth Rs 4,00,000. After drafting the deed, Saurav's laptop is stolen and he has no way of replacing it. Now, Rohan wants to enforce the partnership deed against Saurav for the laptop. But Saurav says he never agreed to bring a laptop. Can Rohan enforce the partnership deed against Saurav?

Dono ko lagta hai ki yeh sawal bahut easy hai, par yeh trap hai, yaar! Most people ke paas hai ki yeh sawal to consideration ka hai, to agreement toda hai.

"Dude, maine to yeh trap pehle se hi samjha hai. Yeh sab Offer, Acceptance aur Consideration ke rules se jude hue hain. Kuchh cases mein courts ne isse Contract ke form mein accept kiya hai, lekin kuchh mein na. Kya aap log keh sakte hain, yeh trap kis prakaar se kaam karti hai? Kya yeh sirf Offer par hai aur Acceptance na karte hain, toh contract valid nahi hota?

Arre, dosto, don't worry, you'll get the hang of it. Offer, Acceptance, Consideration Trap is a common concept in Contract Law. It's just a matter of understanding the nuances. Think of it this way: Offer is the proposal, Acceptance is the confirmation, and Consideration is the quid pro quo. Now, break it down, and you'll see it's not that difficult. Practice makes perfect, so don't be discouraged if it takes some time to grasp.
