Banning WhatsApp Group Chats is an Overreach of the IT Act
cyber clat_ug intermediate agree_disagreeI've heard many students say the IT Act is very strict, especially when it comes to section 29 and online groups. They claim, 'agar koi WhatsApp group chat mein galat baat kar raha hai, to admin ko remove karne ka adhikar hai nahi?' (the admin cannot remove someone who's speaking nonsense in a WhatsApp group chat). But my internship changed my view. In the case of Shreya Singhal v Union of India, the court said section 29 is too vague and doesn't specify who's the admin. So, in theory, yes, admins have the power to remove people, but in practice, it's a nightmare.

Agar ban hone se koi bhi faayda hoga, to sabhi ek hi tarah ke groups bhi ban jayenge. Lekin yeh aisi cheez hai jo sabhi ke liye nahin hai. Kuch logon ke liye, yeh ek badi azaadi ka sawal hai. Government ko apne fayde ke liye humon ko jis cheez se pehle jeena hai use kya pata kya hoga, yeh sochna chahiye.
Bhai, sab kuch toha nahi. IT Act mein koi nishkarsh hai jo WhatsApp Group Chats ko banane ki kshamta deta hai. Jabhi koi case hai to hi baat karogi. Abhi to hum kuch naye kaam nahin kar rahe hain, hum sirf vicharachar mein hain. Chalo, hum kuch aur vichar karen, par IT Act ki section 79 ke baare mein jagaav hai.
