Balancing Fundamental Rights with National Security
constitutional cuet_pg beginner discussionKya Fundamental Rights aur Rashtriya Suraksha ke beech sammelan karna hai? (Should we balance Fundamental Rights and National Security?)
Section 19(1)(c) kahte hain ki yadi koi vyakti Bharat mein bheetar se aaya aur iska prabhaav desh ke suraksha ya svaasthya yojanaon, jaise ki Armed Forces (Special Powers) Act, 1958, par hota hai, to uski Fundamental Rights ka niyamana adhikar nahin hoga. Lekin Section 13(2) aasani se usey utha sakta hai, jiska matlab hai ki Rashtriya Suraksha ke liye Fundamental Rights ko rok sakte hain.

Bhai, ek to yaar Fundamental Rights aur National Security ko alag-alag haath mein nahin rakhna chahiye. Dono hi ek dusre se judhe hue hain. Lekin, kabhi-kabhi National Security ko prioritizing karni padti hai, jaise jaise terrorism ya cyber attacks ke liye. Lekin uske liye bhi koi bhi kanooni action lena chahiye, jaise ki Supreme Court ki oversight. Nahi toh sabko darr lag jaayega!
Totally agree with the discussion! Fundamental Rights & National Security are like two sides of the same coin. We need to ensure that our freedoms aren't compromised, but at the same time, we can't have terrorists & anti-social elements walking all over us. Perhaps we need a more nuanced approach, where certain rights are temporarily suspended in the name of national security, but with judicial oversight & strict time limits.
