Article 355: Centre's Obligation to Safeguard States - Should it be Abolished?
constitutional clat_pg beginner discussionBhai log, I think Article 355 of the Constitution should be scrapped. It's like the Centre is trying to play the hero all the time, but in reality, it's doing more harm than good. The provision says the Centre should protect the states that cannot protect themselves, but what about the states' autonomy? It's like the Centre is always babysitting them, which leads to over-intervention and undermines the federal structure of our Constitution. In India, we've seen cases like Goa vs. Union of India (1973) where the Centre intervened and the Supreme Court even quashed the state's laws. This is not what Article 355 is meant for. It's time we revisit this provision and give states more space to govern themselves. What do you guys think? Should we keep Article 355 or scrap it?
