Article 342: A Colonial Anachronism

Article 342 of the Indian Constitution defines Scheduled Tribes (STs), but the list of STs is based on the British colonial era's criteria. In 2025, this provision makes no sense. It's like saying that the British classification of the Indian caste system is still relevant. The original list of STs was created without consulting the communities themselves, leading to inclusion and exclusion based on colonial biases. The ST list has been amended very rarely, resulting in a mismatch between the Constitution and actual tribal communities. This outdated provision creates problems for groups seeking recognition or fighting for rights, as they're forced to fit into a colonial-era box.

Yeh to sach hai, Article 342 ko todna hi chahiye. Ye colonial legacy hai, aur humein ek akangaa saarvjanikta chahiye. Lekin, humein iska sabut samajhne ke liye isey sudharne ke liye kadam uthanaan hoga. Aap logon ne toh yeh topic bahut ooper chadhaya hai, aur ab humein isey forward le jana hai.
