Article 21 vs Fundamental Freedom - A Slippery Slope

constitutional clat_pg advanced trick_question

Article 21, which guarantees 'right to life' or 'right to liberty', has always been a contentious issue. But what happens when it clashes with a fundamental freedom like freedom of speech or expression? In a recent Constitutional law exam, a question made me think of a clever trick. It said: 'Can you say that a person's life is affected by a law that prohibits obscenity?' The question seems simple, but most students get it wrong. They think that since life is affected, it goes against Article 21. But, what if the law actually promotes a 'right to life' or 'right to dignity' by limiting obscenity that would harm people? The key here is understanding 'life' and 'liberty' in Article 21 - they're not one-dimensional.

Maine kaha tha ki Article 21 ka concept fundamental freedom aur right to life ke beech slippery slope hai. Lekin kuch logon ka yeh vichaar hai ki dono aseem hain aur ek dusre ka vikaas hain. Mujhe lagta hai yeh soch galat hai. Ek baar jaan ka adhikar mil jaata hai, toh fundamental freedom ka koi uthna hi nahin rahega.

"Sir, I think you're absolutely right! Article 21 (Right to Life) aur fundamental freedom ke teen charan (Article 19(1)(a), 19(1)(b) aur 19(1)(c)) mein koi samasya hai. Jab bhi Article 21 ke hiyaan karein, toh fundamental freedom ki gair-maafi hoti hai. Lekin agar koi fundamental freedom ki haami karein, toh Article 21 ke adhishthaan mein aaya ja sakta hai.

"Maine isse Article 21 aur Fundamental Freedom ke beech ka sambandh samajhne mein kai baar confuse hua, lekin ab main samjhta hoon ki dono aise hain jaise do aapne paas hotay hain.
