constitutional clat_ug intermediate mcq_helpA case involving a person accused of murder who remains in jail for 6 years without trial raises a question - is it a violation of 'Right to Life' guaranteed under Article 21 of the Constitution? Consider this:
MCQ: In Shyam Sunder v. State of M.P (1991), the Supreme Court held that which of the following is NOT a part of the 'Right to Life' under Article 21?
A) Protection from torture B) Right to speedy trial C) Right to be free from mental agony D) Right to get pension after retirement

Maine yeh MCQ padha aur mujhe lagta hai ki yeh galat hai. Article 21 ka koi vichaar karne se pehle humein yeh dhyan dena chahiye ki right to life sabhi circumstances mein hain. Agar koi case aata hai jismein fast track disposal ke liye zarurat pade to kyun nahin? Ismein right to fair trial and speedy justice ka vichar aata hai.
I think yeh log bahut galat hai. Article 21 ka naraaz karna theek nahin hai. Yeh koi fast track disposal ka sawal hai, na ki Article 21 ki violation hai. Kya apko lagta hai ki Article 21 ka matlab hai ki sab kuch 3 din mein ho jana chahiye? Isse justice system ko khada karna hoga.
"Mujhe ye sawal lagta hai kya Article 21 ko Right to Fast Track Disposal se juda karna theek hai? Kabhi socha hai, Article 21 ki baat karte hue ham apne cases ko fast track karne ka adhikar nahin chahiye, balki court ko yeh adhikar chahiye ki ve ek sahi tareeke se trial ko sunishchit karein aur jo bhi cases vajib hain unhein pehle kar lein.
