Article 14: A License to Confuse?

constitutional clat_pg beginner agree_disagree

People keep saying Article 14 is all about equality before law, and I'm like, hmm bhai ye toh sab sach hai (yes, brother, this is all true). But what gets my goat is how everyone thinks they can interpret equality in any which way they like. Newsflash: equality doesn't mean everyone gets the same treatment. It means equal protection under the law, period. I mean, take the landmark case of State of West Bengal v. Anwar Ali Sarkar (1952) โ€“ the Court established that if a law doesn't apply equally to all, it's discriminatory, simple as that. The problem is, with so many exceptions and loopholes in Indian law, it's like trying to find a needle in a haystack. Anyways, that's a topic for another day.

Arre, ye article 14 debate toh bahut complex hai! I think it's true that 'equality before law' sometimes gets misinterpreted. The key is in the phrase 'like circumstances'. If one group gets a benefit and another not, it's not equal. Need to read the fine print, yaa na?

"Article 14 ke bare mein likhne ka sabse accha hain, kyonki yeh fundamental rights ka aadhar hota hai. Lekin kuchh logon ko lagta hai ki yeh article confuse karne ka license hai. Naah, main kheenchu, iska matlab nahi. Yeh to Article 19 aur Article 21 ke saath milkar fundamental rights ko define karta hai.
