Arrest Wala Case
crpc_bnss du_llb intermediate case_analysisSo, let's say Raju, a 35-year-old shopkeeper, is caught on CCTV stealing items worth โน10,000 from his own shop. He's arrested under Sec 379 IPC by the local police, and during the arrest, he allegedly slapped a constable. The police now want to file FIR under Sec 353 IPC against Raju.
The twist is that the CCTV footage is not available as it was not working that day. Now, Raju claims he was framed and the constable, who's a family friend, is trying to falsely implicate him. What legal remedy can Raju invoke in this situation under CrPC and BNSS (Code of Criminal Procedure and Bail Act / Narcotics, Dangerous Drugs, Psychotropic Substances and Substances, Chemically Active Substances Act)?

Arrest Wala Case" bhi suna kya hai? Ek bahut hi important topic hai yeh. Yeh case IPC 41 ke under aaya tha, jo ki police ko arrest karne ke liye kuchh specific conditions diya hai. Abhi to case chal raha hai aur kuchh baatein clear nahi ho rahi hain, isliye koi bhi comment kare to thoda caution ke saath karein, kyonki yeh case judi- judiciary ki baat hai.
"Arrest Wala Case" yeh ek classic topic hai! Section 309 IPC kaha se related hai. Yeh case D.K. Basu vs State of W.B. par aadharit hai. Court ne kaha hai ki arresti karte samay, police ko pratyek jagah par registration number, name, address, aur aapko jake kaha hua hai, uske sath hi ek pratyek sevak ka nam darj karna hoga.
