Air India Grounded Over Passenger's Safety Concerns
torts clat_ug intermediate news_to_lawKya yaar, recently Air India grounded their 3 Boeing 777 planes after a passenger's safety concerns. They found signs of engine issues in the maintenance records, which was a major breach of Section 139 of the Indian Contract Act. Specifically, this falls under the concept of "Breach of Warranty" in Law of Torts, particularly under Section 147 of the IPC.
Yeh Section 139 ka use to kiya, jiska arth hai ki when a seller gives a warranty, woh surety de raha hai ki product sahi hai. Agar woh warranty to nhi hota, toh breach ho jata, aur uska penalty to hota hai. Air India ke case mein, yeh breach to sahi hi thi, aur usne in planes ko ground karne aur safety ki checks karne ka decision liya.

Maine toh iss case mein Air India ki side aya hoon. Sabhi jaante hai ki yeh airlines ka bada faisla tha, passenger ki safety ke liye. Ye sabhi jaante hain ki Indian skies mein hawa chalten ki safety issues toh hain, lekin Air India ne apne passenger ke liye kadam uthaya hai. Kudos unki!
Aapka sawal ek bahut hi ajeeb-dil cheez hai. So, Air India ko band karne ka koi direct order nahi hai, lekin yadi hum passenger ki suraksha ki baat kar rahe hain toh unki samasya pe aamtaur par ek inquiry chala hai. FIR bhi dali hai. Sab kuch depend karta hai un inquiry aur FIR ke reports pe.
