Me and my friend were discussing this question on family law and we couldn't agree on the answer. Question is: "Is the consent of the guardian required for adoption under the Hindu Adoption and Maintenance Act, 1956?"

My friend says: "No, because the Act specifically excludes the requirement of guardian's consent for the adoption of an orphan or destitute child."

I disagree, "My friend is wrong because the Act requires the consent of both the child's biological parents, or if the parents are dead or incapable of giving consent from the guardian. So guardian's consent is necessary in many cases, but not always."

Bhai, main to aapke saath agree hoon. According to Sec 6 of Hindu Minority and Guardianship Act, 1956, adoptive parent ka guardian ki zaroorat hoti hai. Bas, main yeh adhikar ke baare mein sochta hoon ki kya yeh kaanoon ka apmaan nahin karta? Kya guardian ke pas pata nahin lagta kisi child ko kis se adopt karne ka?

Maine toh vishwas nahin karta ki adoption ke liye guardian's consent zaroori hona chahiye. Agar koi bachcha apne parivaar se behtar jivan bhuja raha ho to uski adopt karne mein koi baat nahin hai. Guardian ki ichha se koi bachcha apne aapko adopt karne mein rokayega? Nahi, uska apne bachche ka khayal hoga toh.
