Admissible Hearsay: A Case of Section 4A

evidence ap_lawcet intermediate discussion

Yaar, do you think Section 4A of the Indian Evidence Act 1872 should exclude the contents of a document that are hearsay statements, but are found in a reliable source? Section 4A(2) states that if a document is proved to be a reliable source and contains hearsay statements, those statements can be admitted as valid evidence.

But here's the catch, what if the source itself is unverifiable or has a questionable credibility? Can we still consider it a reliable source under Section 4A? Do you think the court should give more weight to the fact that the document itself is reliable, or the credibility of the source it originated from?

I'd say, if the document is reliable, who cares about the source? But tell me, do you think a reliable source is enough to justify admitting hearsay statements under Section 4A? Join the debate!
