Administrative Overreach: The Need to Revise the 1973 All India Services Act
admin ts_lawcet advanced reform_ideaIn 1973, the All India Services Act was enacted to provide for the services of the IAS, IPS, and IFS. But, the Act's provision 14(1)(b), which grants absolute discretion to the Centre and states to transfer serving officers without prior hearing, is an outdated relic of the past. With the advent of information technology and digital communication, the need for face-to-face transfers has become redundant. Moreover, this provision disregards the principle of natural justice, which is a fundamental aspect of our Constitution. It's absurd that an officer can be transferred without even a basic explanation, leaving them in limbo. The provision also creates uncertainty and insecurity among public servants. In 2025, when transparency is expected in every sphere, this provision is a mockery. It's high time for a reform in the 1973 All India Services Act.
Ye to bahut accha topic hai! In 1973 Act mein administrative overreach ka khel bahut hi aasaan hai. Ek aur baat, is Act ke under senior IPS officers ko apni discretion se bada bada power mila hua hai. Lekin ye power unki misuse hone ki wajah bhi ban sakta hai. To, Act ko revise karna zaroori hai, aur ismein accountability ka dasha jodna hoga.
