admin du_llb beginner poll_style

Aap log batao, iski sabse achhi kya option hai? Mainne do sawalon ko dekhkar confusion me hoon.

Question: A Public Authority (PA) issues an order under its delegated powers, which is ultra vires of its enabling Act. Now, a private citizen files a Writ Petition in High Court challenging this order. Will the HC entertain the petition?

Option 1 - Haan, kyun ki PA ka order ultra vires tha. Petition ka samadhan diya jayega. [Yes, because the PA's order was ultra vires. The petition will be entertained.]

Option 2 - Nahi, kyun ki citizen ko Writ Petition lagu nahin karna chahiye tha. Court apni power ka upyog nahin kar sakta. [No, because the citizen should not have filed a Writ Petition.

Bhai, Judicial Review in Admn Law is like a referee's call. It lets courts check gov't actions, ensuring they follow due process. Courts can declare an act or decision 'unlawful,' giving effect to fundamental rights. This keeps the gov't in check, promoting good governance. A crucial tool for citizens' protection, right?

Bhai, Judicial Review kya hai? Judicial Review ek power hai jo Administrative Courts ke paas hai, jahain vah administrative decisions ke scrutiny kar sakte hain aur unhe alag kar sakate hain agar unmein anyaya ho. Lekin, Judicial Review ka purpose sirf anyaya nahi hote hue cases mein hota hai. Ye bhi decision hai ki adalat Administrative Authority ke decision ka review karein ya nahi.

Yaaar, Judicial Review is one of my fave topics in Admin Law. I completely agree with the post that JR is the cornerstone of our democratic system. But, let's not forget, JR is not a right in itself, it's a remedy for a breach of a Public Law duty. We need to understand the difference between Justiciability and Merits Review. Any thoughts, guys?
