Administrative Law: Aajkal Kya Kya Ho Gaya
admin clat_ug beginner pyq_discussionLast year CLAT UG ka sawal tha - "Under the Administrative Tribunals Act, 1985, the Tribunal's order can be challenged in the High Court on grounds of illegality, perversity or procedural irregularity. However, if the High Court holds the order to be illegal or perverse, it may not set it aside but direct for fresh consideration. Analyze the powers of the High Court and the Tribunal in the given scenario."
To solve this, you need to remember the concept of 'mandamus' ki power and how the High Court exercises it on tribunals. Kya Tribunal ke order ko set aside kar sakta hai High Court? Kya Tribunal ke order ko fresh consideration karne ke liye direct kar sakta hai High Court?

Yeh topic bahut hi interesting hai! Administrative Law ke liye kai judi cases hain jo aajkal hui hain. Jaise ki, Goa Foundation vs State of Goa (2000) mein, HC ne government ko forest conservation act ka pura paalan karna padna tha. Aur phir, Narmada Bachao Andolan case (2000) mein, SC ne Narmada dam ke virodh mein SC/ST act 1989 ka application karke government ko notification issue karni padni thi.
"Arre yaar, abhi aajkal administrative law mein kayi changes ho gaye hain. Administrative tribunals adhiniyam 2015 ke under, administrative tribunals banaaye gaye hain jinhone high court ki adalaton ka kaam karna shuru kiya hai. Iske alawa, Centre for Public Interest Litigation (CPIL) aur Loknayak Jaya Prakash Narayan National Centre for Justice and Peace (LNJP) jaise organizations bhi kafi aktiiv ho gayi hai.
