Administrative Action: Kinds of Injuries
admin mh_cet_law advanced poll_styleMeh, I'm stuck on this question and need your help. MH CET Law is coming up and I've been reading through the syllabus. I have 2 options for the types of injuries in administrative law and I'm not sure which one is correct.
Option A: The Supreme Court in State of Punjab v. Devi Das, (1971) 3 SCR 478, held that there are three types of injuries in administrative actions: (i) mere mistakes, (ii) malafide actions and (iii) ultra vires actions.
Option B: In a similar case, State of Bihar v. Kameshwar Singh, (1952) SCR 118, the court only identified two types of injuries: (i) mere mistakes and (ii) malafide actions.
So, which one is correct and why? Have I made a mistake in my notes?
